Terms of Use
These Terms of Use (“Terms”) govern access to and use of Bodle TV software, the bodle.tv website, reseller panel, APIs, and related applications (collectively, the “Service”). By using the Service, you agree to these Terms.
1. Platform provider only
Bodle is a software and platform provider only. We supply technology that allows resellers and users to configure how devices connect to playlists, portals, and streams. Bodle does not host, provide, sell, endorse, curate, or verify any television channels, video-on-demand libraries, playlists, stream URLs, electronic programme guide (EPG) data, or other third-party content.
2. Your responsibility for content and playlists
You — and, where applicable, your reseller or end users — are solely responsible for all playlists, stream URLs, portal credentials, branding, and content you configure through the Service. You represent and warrant that:
- You have all necessary rights, licences, and permissions to access, use, and distribute any content or streams you configure;
- Your use complies with applicable copyright, broadcasting, telecommunications, and consumer laws in every jurisdiction where you operate;
- You will not use the Service for unlawful, infringing, or abusive purposes.
Bodle has no obligation to monitor, review, or approve user-configured content or playlists.
3. No warranty on playlists or streams
The Service is provided in connection with third-party sources you choose. Bodle makes no warranty regarding playlist availability, stream quality, buffering, compatibility, accuracy of EPG data, uptime, legality, or fitness for any particular purpose. Interruptions, errors, and failures may occur at any time without notice.
4. Disclaimer of liability
To the fullest extent permitted by applicable law, Bodle and its officers, directors, employees, and affiliates disclaim all liability for any claims, losses, damages, penalties, or expenses arising from or related to:
- Copyright infringement, unauthorised streaming, or other intellectual property violations;
- Illegal streams, pirated content, or DMCA or similar takedown actions;
- Playlist failures, broken URLs, expired credentials, or misconfigured portals;
- Buffering, playback errors, device incompatibility, or poor stream quality;
- EPG inaccuracies, missing programme data, or incorrect metadata;
- Service outages, downtime, data loss, or security incidents;
- Actions, omissions, or failures of third-party hosting, CDN, playlist, or streaming providers;
- Any content accessed through configurations you or your users submit.
Your sole remedy for dissatisfaction with the Service is to stop using it.
5. Indemnification
You agree to indemnify, defend, and hold harmless Bodle and its affiliates from any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your playlists, streams, or content; (b) your breach of these Terms; (c) your violation of any law or third-party right; or (d) any dispute between you and your customers, resellers, or content providers.
6. Limitation of liability
To the maximum extent permitted by law, Bodle’s total aggregate liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amounts you paid to Bodle for the Service in the twelve (12) months before the claim, or (b) one hundred Australian dollars (AUD $100). Bodle shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
7. Service provided “as is”
The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Account suspension and termination
Bodle may suspend or terminate access to the Service immediately, with or without notice, if we reasonably believe you have violated these Terms, abused the platform, posed a security risk, or engaged in conduct that may expose Bodle to legal liability. You may stop using the Service at any time.
9. Reseller relationships
If you access the Service through a reseller, your reseller may impose additional terms. Bodle is not a party to agreements between resellers and their customers and is not responsible for reseller conduct, pricing, or support obligations.
10. Age and local law compliance
You must be at least 18 years old (or the age of majority in your jurisdiction) to create a reseller account. All users are responsible for ensuring their use of the Service complies with local laws, including content licensing and device regulations in their country or region.
11. Intellectual property
Bodle retains all rights in the Bodle TV software, branding, and platform. These Terms do not grant you any ownership in our intellectual property. You grant Bodle a limited licence to process configuration data you submit solely to operate the Service.
12. Changes to the Service and Terms
We may modify the Service or these Terms at any time. Material changes will be reflected by updating the “Last updated” date. Continued use after changes constitutes acceptance where permitted by law.
13. Governing law
These Terms are governed by the laws of Australia, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Australia for disputes arising from these Terms or the Service, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
14. General
If any provision of these Terms is held invalid, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These Terms constitute the entire agreement between you and Bodle regarding the Service.
